Terms of Service

Last updated: 16 September 2026

1. About us

3 Minute Marketing is a trading style of Lycosa Web Services Ltd, a company registered in England and Wales ("we", "us", "our"). These Terms of Service ("Terms") govern your access to and use of the 3 Minute Marketing website, web application, mobile app, and all related services (collectively, the "Service").

By registering for or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

2. Definitions

  • "Primary User" means the individual or business that holds the account, is responsible for payment, and has full administrative control over the account.
  • "Staff Member" / "Contributor" means any person added by the Primary User to submit content on their behalf. Staff Members do not have publishing rights.
  • "Content" means any text, images, job details, or other material submitted via the Service.
  • "Rewritten Content" means Content that has been edited, reformatted, or rewritten by us for presentation purposes.
  • "Third-Party Platforms" means Google Business Profile, website directories, social media accounts, and any other external platforms to which Content may be submitted.

3. The Service

3 Minute Marketing provides a platform that allows tradespeople to log completed jobs, which we then rewrite into professional posts for potential publication on Third-Party Platforms. The Service is dependent on the regular submission of job content by Primary Users and/or their Staff Members.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice, except where immediate action is required for legal, security, or operational reasons.

3a. Newsletters and audience measurement

The Service includes an optional email newsletter. Businesses may invite their own customers to subscribe, and 3 Minute Marketing will prepare and send newsletter emails on their behalf. Each business is responsible for the accuracy and legality of the content it causes to be sent, and for ensuring it has a lawful basis to email each recipient.

Links within newsletter emails pass through 3 Minute Marketing before reaching their destination. 3 Minute Marketing records only aggregate, non-identifying counts of link clicks (the newsletter, article and destination clicked, not the identity of the subscriber) in order to show the sending business what their audience finds useful. This does not involve building a profile of any individual recipient.

4. Content submission and moderation obligations

In order for the Service to function effectively, Primary Users are required to submit details of completed jobs a minimum of four (4) times per calendar month. This requirement is fundamental to the nature of the Service.

We will send reminder notifications to Primary Users who have not met this minimum within a given month. Failure to submit the minimum required content will result in the following escalating process:

  • Strike 1: A written reminder is issued.
  • Strike 2: A formal warning is issued, noting that continued failure may result in suspension.
  • Strike 3: The account may be suspended or cancelled at our discretion, with no refund of any prepaid subscription fees.

Strikes reset at the start of each calendar quarter, provided the minimum submission requirement has been met consistently in the preceding period.

4a. Content protection and Google policy compliance

We are committed to protecting the integrity of content submitted to our platform and to Google Business Profile. All user-submitted content is automatically checked for prohibited, restricted, or risky material before being processed or sent to Google. This includes, but is not limited to, checks for:

  • Profanity, hate speech, adult content, violence, and illegal services
  • Personal/confidential data (phone numbers, emails, addresses, number plates, document numbers, etc.)
  • Impersonation, fake or misleading content, testimonials, and solicitation of personal information
  • Links, off-topic, or repetitive content

We use both automated and AI-based moderation to ensure compliance with our own standards and with the Google Business Profile content policy. Our moderation pipeline is designed to prevent the submission of any content that could violate these policies, and we maintain an audit trail of all moderation actions. Users are required to review and approve all rewritten content before it is published to Google or any third-party platform.

5. Content accuracy and legal responsibility

All Content submitted via the Service — whether by a Primary User or a Staff Member — is the sole legal responsibility of the Primary User. You warrant that:

  • All Content submitted is accurate, truthful, and relates to work genuinely completed by your business.
  • You hold all necessary rights, licences, and permissions for any images or other materials submitted.
  • The Content does not infringe any third-party intellectual property rights, defame any person, or violate any applicable law or regulation.
  • You have obtained any necessary consents from customers or third parties featured in the Content.

Rewritten Content produced by us is presented to the Primary User for review before publication. Final moderation, approval, and submission of any Content to Google Business Profile, websites, directories, social media, or any other Third-Party Platform is the sole responsibility of the Primary User. We accept no liability for the accuracy, legality, or consequences of any Content once it has been approved and published by the Primary User.

6. Staff Members and Contributors

Primary Users may add Staff Members or Contributors to their account to submit job Content on their behalf. Staff Members:

  • May submit job details and supporting images for moderation.
  • May not approve, publish, or submit Content to any Third-Party Platform.
  • Must comply with these Terms as if they were the Primary User.

The Primary User is fully responsible for all actions taken by their Staff Members within the Service. We reserve the right to suspend or remove individual Staff Member access at the request of the Primary User, or independently where we have reason to believe that access is being misused.

7. Payment and billing

Subscription fees are payable monthly in advance by Direct Debit through GoCardless. Payment is taken at the start of each billing month using the payment method you save during billing setup.

All fees are stated exclusive of VAT unless otherwise indicated. VAT will be charged where applicable at the prevailing rate.

We reserve the right to change our pricing with not less than 30 days' written notice. Continued use of the Service after a price change takes effect constitutes acceptance of the new pricing.

8. Non-payment and service restriction

If a payment fails or is not received by the due date, we reserve the right to:

  • Restrict access to all or part of the Service with immediate effect.
  • Suspend new Content processing until outstanding amounts are settled.
  • Cancel the account entirely if payment remains outstanding for more than 14 days following the due date.

Cancellation due to non-payment does not entitle the Primary User to a refund of any previously collected fees. We will make reasonable efforts to notify you of a failed payment before taking any of the above actions.

9. Cancellation

Cancellation by you: You may cancel your subscription at any time by contacting us in writing. Cancellation will take effect at the end of the current billing month. No refunds are provided for the remainder of a billing period already paid.

Cancellation by us: We reserve the right to cancel your account at any time by giving you not less than 30 days' written notice, or with immediate effect where:

  • You have materially breached these Terms and (where the breach is capable of remedy) have failed to remedy it within 14 days of notice.
  • You have reached three content submission strikes as described in clause 4.
  • Payment remains outstanding in accordance with clause 8.
  • We are required to do so by law or a regulatory authority.
  • Continuing to provide the Service to you would expose us to legal or reputational risk.

10. Acceptable use

You agree not to use the Service to:

  • Submit false, misleading, or fabricated job details or images.
  • Infringe the intellectual property rights of any third party.
  • Harass, defame, or harm any individual or business.
  • Distribute spam, malware, or any harmful code.
  • Attempt to gain unauthorised access to any part of the Service or its infrastructure.
  • Use the Service in any way that violates applicable UK law or regulation, including but not limited to the Consumer Protection from Unfair Trading Regulations 2008, the Advertising Standards Authority (ASA) guidelines, and the UK GDPR.
  • Resell, sublicence, or otherwise commercialise access to the Service without our prior written consent.

We reserve the right to remove any Content that we reasonably believe violates this clause, and to suspend or terminate accounts involved in such activity without notice.

11. Intellectual property

The 3 Minute Marketing platform — including its source code, web application, mobile application, design, databases, algorithms, and all associated materials — is the exclusive intellectual property of Lycosa Web Services Ltd and is protected by copyright and other applicable intellectual property laws.

© Lycosa Web Services Ltd 2026. All rights reserved.

You retain ownership of all original Content you submit. By submitting Content, you grant us a non-exclusive, royalty-free licence to process, reformat, and present that Content as part of the Service.

You may not copy, reproduce, decompile, reverse-engineer, or create derivative works from any part of the Service without our prior written consent.

12. Limitation of liability

To the fullest extent permitted by law:

  • We shall not be liable for any indirect, consequential, special, or incidental loss or damage arising out of or in connection with your use of the Service.
  • We shall not be liable for any loss of profit, loss of revenue, loss of business, loss of data, or loss of goodwill.
  • Our total aggregate liability to you in connection with the Service shall not exceed the total fees paid by you in the three (3) months immediately preceding the event giving rise to the claim.
  • We accept no liability for the actions, content, or decisions of any Third-Party Platform, including but not limited to Google.
  • We accept no liability for any loss arising from your failure to review, moderate, or approve Content before publication.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.

13. Disclosure to law enforcement and authorities

We reserve the right to disclose your account information, Content, and any other data we hold about you to law enforcement agencies, regulatory authorities, or other third parties where we are legally required to do so, or where we reasonably believe that such disclosure is necessary to:

  • Comply with a legal obligation or court order.
  • Protect the rights, property, or safety of Lycosa Web Services Ltd, its employees, its users, or the public.
  • Detect, prevent, or address fraud, security, or technical issues.

14. Force majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, civil unrest, government action, industrial disputes, failure of third-party infrastructure or services (including internet service providers, cloud hosting providers, or Google's APIs), pandemics, or power failures.

In the event of a force majeure, we will notify you as soon as reasonably practicable and will use reasonable endeavours to resume normal service as quickly as possible. If a force majeure event continues for more than 30 days, either party may cancel the subscription without penalty.

15. Third-party services

The Service integrates with third-party platforms and services including but not limited to Google Business Profile, GoCardless, and Firebase. Your use of those platforms is subject to their own terms of service and privacy policies. We are not responsible for the availability, accuracy, or conduct of any third-party service.

We do not guarantee that integration with any Third-Party Platform will remain available. If a third-party service changes its API, policies, or access terms in a way that affects the Service, we will make reasonable efforts to adapt, but cannot guarantee continuity of any specific feature.

16. Data protection

We process personal data in accordance with our Privacy Policy and applicable UK data protection law, including the UK GDPR and the Data Protection Act 2018. By using the Service, you confirm that you have read and understood our Privacy Policy.

17. Changes to these Terms

We may update these Terms from time to time. We will notify you of material changes by email or via the Service with not less than 14 days' notice before the changes take effect. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms.

18. Governing law and disputes

These Terms are governed by and construed in accordance with the laws of England and Wales. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Before commencing any legal proceedings, both parties agree to attempt to resolve any dispute in good faith through negotiation for a period of not less than 30 days.
